1.Introduction and Acceptance
These Terms of Service, or Terms, form a binding agreement between you and the operator of Tela. In these Terms, Tela, we, us, and our refer to the developer or service operator identified for Tela in the applicable app store listing or an in-service legal notice.
These Terms govern your access to and use of the Tela mobile application, related websites, creator tools, community features, Lights, virtual gifts, paid creator video sessions, customer support, and any other service that links to these Terms, collectively referred to as the Services.
By creating an account, accessing the Services, applying to become a creator, publishing content, making a purchase, or otherwise using Tela, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not access or use the Services.
The Services are offered only where lawful. Access from a particular location does not mean that every feature is available or legally permitted there. You are responsible for complying with laws that apply to your use of Tela.
2.Related Policies and Feature-Specific Terms
These Terms should be read together with the Tela Privacy Policy, Community Guidelines, Creator Terms, purchase disclosures, cancellation rules, and any additional terms presented for a particular feature. Those documents are incorporated into these Terms by reference where applicable.
If feature-specific terms conflict with these Terms, the feature-specific terms control only for that feature. Creator Terms control creator verification, monetization, payouts, and creator obligations to the extent they provide more specific rules. The applicable app marketplace terms also govern transactions processed by that marketplace.
A translation may be provided for convenience. Unless applicable law requires otherwise, the English version controls if a translation conflicts with the English text.
3.Eligibility and Adult-Only Access
Tela is intended exclusively for users who are at least 18 years old. You may not create an account or use the Services if you are under 18, or if the law in your location requires a higher minimum age for the relevant feature.
By using Tela, you represent that you meet the applicable minimum age, have the legal capacity to enter into these Terms, and are not prohibited by law from receiving the Services. You may not use Tela if we previously terminated your account for serious or repeated violations unless we give written permission.
We may use age declarations, identity information, verification methods, or other reasonable signals to confirm eligibility. If we reasonably believe that an account belongs to a minor, we may restrict access, preserve information required for safety or legal purposes, and terminate the account.
A parent, guardian, or other person who believes that a minor is using Tela should contact service@tela.love and provide information sufficient to identify the account.
4.Account Registration and Security
You must provide accurate, current, and complete registration information and keep it updated. You may not impersonate another person, use misleading identity information, create an account for someone without authority, or register accounts primarily to evade enforcement.
You are responsible for protecting your login credentials and devices and for activity conducted through your account, except to the extent caused by unauthorized access that you promptly report and did not facilitate. Notify us immediately at service@tela.love if you suspect account compromise.
You may not sell, rent, transfer, sublicense, or share control of your account. If third-party sign-in is available, your use of that sign-in service is also subject to the provider's terms, and you remain responsible for keeping the linked account secure.
We may require account verification, password changes, or additional security steps when we detect unusual activity. Failure to complete a reasonable security check may result in temporary restrictions.
5.Limited License to Use Tela
Subject to these Terms, Tela grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to install and use the application and access the Services for their intended purposes.
This license does not permit you to copy, modify, distribute, sell, lease, publicly perform, publicly display, reverse engineer, decompile, extract source code from, or create derivative works from any part of the Services, except where applicable law expressly permits an activity that cannot be contractually restricted.
Tela and its licensors retain all rights in the application, service design, software, databases, trademarks, logos, and materials provided by Tela, excluding User-Generated Content owned by users. No right is granted by implication.
6.Creator Applications and Real-Person Verification
Eligible users may apply to become Tela Creators. Creator access is not automatic. We may require real-person, identity, age, liveness, payout, tax, or other verification before granting or continuing creator features.
You must submit authentic materials that relate to you and must not alter documents, use another person's image or identity, or assist anyone in bypassing verification. Verification information is handled as described in the Tela Privacy Policy and any notice shown before collection.
Completing verification does not guarantee approval, continued creator status, increased distribution, bookings, or earnings. We may deny, pause, or revoke creator access if information is incomplete, inaccurate, expired, associated with fraud or impersonation, or inconsistent with safety and eligibility requirements.
Creators act independently. Creator status does not create employment, partnership, agency, fiduciary, franchise, or joint-venture relationships with Tela. A creator may not make commitments, warranties, or representations on Tela's behalf.
7.Community Conduct
Tela is built for respectful, interest-led participation. You must treat other users with dignity, respect personal boundaries, and use community features for authentic creative exchange rather than harassment, coercion, deception, or exploitation.
You must not threaten, bully, stalk, intimidate, shame, discriminate against, sexually harass, or expose the private information of another person. Unwanted sexual conduct, repeated contact after a person has asked you to stop, and attempts to pressure users into payments or off-platform interaction are prohibited.
You must not use Tela to promote violence, self-harm, criminal activity, dangerous challenges, regulated goods sold unlawfully, prostitution, escort services, sexual services, human trafficking, or exploitation. You must follow the Community Guidelines and reasonable safety instructions presented in the Services.
Differences of opinion are permitted, but coordinated abuse, hateful attacks, deceptive campaigns, and conduct that creates a credible risk of harm may result in immediate action.
8.User-Generated Content and Posting Standards
User-Generated Content, or UGC, includes profile information, photos, videos, audio within videos, captions, comments, replies, creator materials, links, reports, appeals, and other content submitted through the Services. You are solely responsible for the UGC you submit and the consequences of making it available.
You may upload or publish UGC only if you own it or have all rights, permissions, releases, and consents needed to use it on Tela. If content depicts or identifies another person, you must respect that person's privacy, publicity, and other rights.
UGC must not include unlawful, pornographic, exploitative, hateful, threatening, defamatory, fraudulent, dangerously misleading, or excessively violent material. It must not contain malware, unauthorized personal data, instructions intended to facilitate serious wrongdoing, or content that infringes copyright, trademark, privacy, publicity, or other rights.
Creators must clearly disclose paid endorsements, sponsorships, material brand relationships, and materially altered or synthetic media when disclosure is required by law, platform rules, or the Community Guidelines. You must not present fabricated credentials, results, testimonials, or expertise as genuine.
Content published in a public or community-facing area may be viewed, copied, captured, shared, or discussed by others. Do not publish information that you expect to remain confidential.
9.Ownership of UGC and License to Tela
You retain the ownership rights that you hold in your UGC. Tela does not acquire ownership merely because you submit content to the Services.
To operate Tela, you grant Tela a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, transmit, display, perform, distribute, format, transcode, translate, create technical adaptations of, moderate, and otherwise use your UGC. This license is limited to operating, securing, improving, and promoting the Services and enabling the sharing choices you make.
For public UGC, the license includes permission to display your username, profile image, creator status, and content in feeds, recommendations, previews, search results, Tela promotional materials, and links that direct people to the content or creator profile. Tela will not use raw identity-verification materials for public promotion.
The license generally ends when your UGC is deleted from active systems, except that copies may remain for a limited time in backups, in content already shared by others, or where retention is reasonably necessary for safety, fraud prevention, dispute resolution, legal obligations, or enforcement.
You represent that granting this license does not violate any agreement or third-party right. You may not imply that Tela endorses you, your content, or any product or service unless Tela has given written authorization.
10.Content Moderation, Reporting, Blocking, and Appeals
Tela may use automated systems, human review, user reports, trusted safety signals, and other reasonable methods to detect and address content or conduct that may violate these Terms, the Community Guidelines, or law. We are not required to monitor every item before it appears.
Users can report content or accounts and block users through available in-app tools. Reports must be made in good faith. Knowingly false, retaliatory, duplicative, or abusive reports may themselves violate these Terms.
We may remove, restrict, label, age-gate, downrank, demonetize, preserve, or disclose content, and may limit features or accounts, when reasonably necessary for safety, integrity, legal compliance, or enforcement. We may also refer credible threats, exploitation, fraud, or apparent criminal activity to appropriate authorities.
Where an appeal process is available, you may submit relevant context within the stated period. We may uphold, modify, or reverse a decision. Detailed investigative information may be withheld when disclosure would compromise safety, privacy, security, legal obligations, or confidential systems.
Moderation reduces risk but cannot guarantee that all content is lawful, accurate, suitable, or harmless. Use judgment when relying on content or interacting with others.
11.Copyright, Trademark, and Other Rights Complaints
Tela respects intellectual property and may remove or restrict content that infringes copyright, trademark, or other rights. Rights holders or authorized representatives may send a notice to service@tela.love with the subject line Copyright Notice or Rights Complaint.
A notice should identify the protected work or right, locate the challenged content, provide the complainant's contact information, explain the basis of the claim, include a good-faith statement, and confirm that the information is accurate and the sender is authorized to act. A signature may be required where applicable law requires it.
We may share the notice and relevant contact information with the affected user when necessary for a fair response or counter-notice process. Users whose content is removed may submit a response or counter-notice if available under applicable law.
We may terminate repeat infringers in appropriate circumstances. Submitting a knowingly false or materially misleading claim may create legal liability and may result in account action.
12.Creator Profiles, Public Activity, and Representations
Creator profiles may display public information such as a display name, username, profile image, biography, categories, verification status, posts, follower counts, engagement, Lights, gifts, session availability, and other information selected for public display.
A verification badge or creator status means only that the applicable verification steps were completed at the relevant time. It is not an endorsement, guarantee of identity beyond the verified scope, certification of expertise, promise of quality, or assurance that every statement is accurate.
Creators must keep public representations truthful and must not claim qualifications, licenses, affiliations, achievements, or experience they do not hold. Creators are responsible for legally required advertising, sponsorship, professional, and commercial disclosures.
Follows, recommendations, rankings, Lights, gifts, or bookings do not constitute an endorsement by Tela.
13.Discovery, Recommendations, and Engagement Integrity
Tela may organize feeds, search results, creator suggestions, notifications, and other discovery surfaces based on interests, activity, content characteristics, quality, freshness, safety, region, language, and other signals described in the Privacy Policy.
We do not guarantee that any post or creator will receive a particular position, audience, engagement level, number of followers, amount of support, session demand, or earnings. Distribution may change as systems, community interests, and safety rules evolve.
You must not artificially inflate views, follows, comments, Lights, gifts, bookings, or other metrics through bots, coordinated exchanges, self-dealing, misleading incentives, purchased traffic, or deceptive activity. We may adjust metrics and reverse associated benefits when manipulation is detected.
14.Lights and Light Up Interactions
A Light Up is a way for a user to recognize and support an eligible creator's post. Depending on the feature design, sending a Light may require a purchased virtual item, credit, or other in-app entitlement displayed before confirmation.
Lighting Up an eligible post may unlock the option to request or book a paid one-to-one creator video session. A Light does not include the session price, guarantee that the creator is available, require the creator to accept a request, or guarantee that a session will occur.
A Light does not give the sender ownership of content, creative control, a debt or equity interest, voting rights, a charitable receipt, or any right to direct the creator's conduct. It is not a donation, investment, loan, or wager.
Eligible creators may receive a share of value associated with Lights under the Creator Terms. The displayed cost of a Light is not necessarily equal to the creator's payout after marketplace charges, platform terms, taxes, refunds, chargebacks, fraud adjustments, or other disclosed deductions.
Once a Light is validly sent and applied, it is normally final and cannot be transferred or withdrawn, except where required by law, marketplace policy, or correction of a verified technical or billing error.
15.Virtual Gifts
Tela may allow users to purchase or use virtual items to send gifts to eligible creators during supported interactions. Gifts are digital expressions within Tela and have no physical form.
A user who sends a gift receives no ownership interest, repayment right, cash value, or right to goods or services unless a specific offer clearly states otherwise. Gifts cannot be resold, traded, transferred outside supported features, or redeemed for cash by the sender.
An eligible creator may receive earnings associated with gifts only under the applicable Creator Terms. A gift icon, coin amount, or displayed virtual value does not represent the creator's final payout and is not a stored bank balance.
Gifts must not be used for bribery, coercion, sexual services, gambling, money laundering, self-dealing, payment evasion, or manipulation of platform metrics. We may cancel a gift transaction and adjust related balances or earnings when fraud, error, chargeback, or a serious policy violation is established.
16.Paid Creator Video Sessions
Where available, users who meet the displayed eligibility conditions may request or book a paid one-to-one video session with an eligible creator. The creator's availability, session length, price, permitted topics, and material cancellation terms will be displayed before purchase or confirmation.
Tela provides technology and marketplace support for sessions, but creators independently provide their participation and content. Unless expressly stated, Tela is not a party to professional advice, coaching claims, promises, or separate arrangements made by a creator.
Sessions are for lawful adult creator-community interactions. They must not be used for sexual services, nudity requested for sexual gratification, prostitution, escort arrangements, harassment, threats, coercion, illegal transactions, dangerous instruction, or contact with a minor. A session is not an emergency, medical, mental-health, legal, investment, or other regulated professional service unless Tela has expressly approved and labeled the feature and the creator is lawfully qualified.
Participants must respect privacy and may not record, screen-capture, rebroadcast, or disclose private session content without the other participant's express consent and any consent required by law. Participants should avoid sharing unnecessary financial, identity, location, or other sensitive information.
Session quality depends on devices, permissions, networks, and participant availability. If a session is interrupted, cancelled, or missed, the cancellation and refund rules shown at booking and Section 19 apply. Tela may review session metadata and safety reports, but private audio or video is not recorded by default unless all required notice and consent are provided.
A booking does not guarantee a particular result, relationship, future access, or off-platform contact. Attempts to bypass Tela's payment, safety, or reporting systems may result in account restrictions.
17.In-App Purchases, Prices, and Billing
Tela may offer virtual items, Lights, gifts, paid creator sessions, and other digital features for purchase. On iOS, digital content and functionality will be offered through Apple's in-app purchase system where required by Apple's rules. Other platforms may use their approved billing systems.
The price, currency, quantity, applicable taxes, and material terms will be displayed before you confirm a transaction. Prices and product configurations may vary by region, marketplace, promotional eligibility, or creator, and may change for future transactions.
By confirming a purchase, you authorize the applicable app marketplace or payment provider to charge the payment method associated with your account. The marketplace or provider may issue the receipt, collect taxes, apply currency conversion, and determine available payment methods under its own terms.
Where a purchase is restorable under marketplace rules, Tela will provide an appropriate way to restore the entitlement associated with the same marketplace account.
Tela generally does not receive your full payment-card number for purchases processed by an app marketplace. A failed, reversed, unauthorized, or disputed payment may result in cancellation of the related entitlement and a corresponding balance adjustment.
18.Virtual Items, Credits, and Balances
Virtual items, credits, coins, Lights, gifts, and similar digital units are limited, revocable licenses to use specified features within Tela. They are not money, deposits, securities, cryptocurrency, stored value, or property rights, and they do not earn interest.
Virtual items may be used only in the manner shown in the Services. You may not sell, exchange, transfer, broker, or trade them outside Tela, and third-party markets are not authorized. Tela is not responsible for losses arising from prohibited transfers or account sharing.
Purchased credits or in-app currencies obtained through Apple's in-app purchase system do not expire. Other purchased credits do not expire where applicable marketplace rules or law prohibit expiration. Promotional, complimentary, bonus, or test items may expire or be withdrawn if their conditions clearly disclose that limitation. We may correct balances created by technical error, duplicate delivery, fraud, refund, chargeback, or unauthorized activity.
If Tela materially changes or discontinues a virtual item, we will handle unused purchased entitlements as required by applicable law and marketplace policy. Closing or terminating an account may affect access to virtual items as described in Sections 19 and 27.
19.Refunds, Cancellations, and Chargebacks
Purchases are final and non-refundable except where a refund is required by applicable law, allowed by the applicable marketplace, promised in a displayed cancellation policy, or granted to correct a verified billing or technical error.
For purchases processed by Apple, refund requests must generally be submitted to Apple and are governed by Apple's refund process and terms. Tela cannot guarantee or override a marketplace's refund decision.
Consumed virtual items, completed Lights, and delivered gifts are normally not returnable. If an unauthorized transaction, duplicate charge, or delivery failure occurs, contact the marketplace and service@tela.love promptly with the transaction identifier, but do not send a full payment-card number.
Creator-session cancellation rules will be shown before booking. If a creator cancels or a paid session cannot be delivered, the user may receive a rescheduled session, in-app credit, or refund through the original processor as stated in the displayed policy and required by law. A user no-show or late cancellation may be non-refundable if clearly disclosed before purchase.
Before initiating a chargeback, you should use available marketplace or Tela support channels so the issue can be investigated. We may restrict purchases or suspend an account for fraudulent or abusive chargebacks, but nothing in these Terms limits a lawful right to dispute an unauthorized or incorrect charge.
20.Creator Earnings and Payouts
Eligible creators may receive earnings associated with valid Lights, gifts, and completed creator sessions, subject to verification, region availability, minimum thresholds, payout schedules, reserves, and the Creator Terms displayed to the creator.
Displayed creator earnings may be estimated or pending until the underlying transaction clears and all applicable conditions are met. Final payout amounts may reflect marketplace commissions, platform or processing fees disclosed to the creator, taxes, refunds, chargebacks, fraud adjustments, currency conversion, reserves, and other lawful deductions.
A creator must provide accurate legal, tax, identity, and payout information and maintain an eligible payout account. We may delay, hold, reverse, or refuse a payout where reasonably necessary to verify ownership, resolve a dispute, address suspected fraud, comply with sanctions or law, protect users, or correct an error.
Tela does not guarantee any minimum distribution, audience, booking volume, earnings, payout frequency, or commercial success. Creators must not purchase their own support, coordinate sham transactions, or use another account to create artificial earnings.
Creators provide services independently and are not employees or agents of Tela. They are responsible for expenses, insurance, licenses, registrations, and obligations associated with their creator activity unless applicable law states otherwise.
21.Taxes and Financial Compliance
Users are responsible for taxes associated with their transactions to the extent those taxes are not collected and remitted by an app marketplace, payment provider, or Tela. Prices may include or exclude taxes depending on the storefront and applicable law.
Creators are responsible for determining and reporting taxes arising from earnings. Tela or a payout provider may collect tax forms, report payments, or withhold amounts when required by law. Failure to provide required information may delay or prevent payout.
Transactions and payouts may be screened for fraud, sanctions, anti-money-laundering requirements, and other financial compliance obligations. Tela may reject or restrict a transaction that cannot lawfully be processed.
Tela does not provide tax, legal, investment, or accounting advice. You should consult a qualified adviser regarding your circumstances.
22.Children's Safety, CSAE, and CSAM
Tela is an adults-only service. Users under 18 are not permitted to create accounts, become creators, purchase features, send gifts, or participate in creator video sessions.
Tela has zero tolerance for Child Sexual Abuse and Exploitation (CSAE). Prohibited conduct includes grooming, sexual solicitation of a minor, sextortion, trafficking, attempts to arrange sexual contact with a minor, sexualized depiction of a minor, and the creation, possession, promotion, sharing, or distribution of Child Sexual Abuse Material (CSAM), including synthetic or manipulated material where prohibited.
Users must not request, create, upload, save, transmit, or redistribute apparent CSAM. When reporting suspected illegal material, do not download, copy, forward, or otherwise circulate it. Use the in-app reporting tools or contact service@tela.love. If a child faces immediate danger, contact local emergency services.
We may immediately remove content, disable features, terminate accounts, preserve evidence, and report apparent CSAE or CSAM and relevant account information to the National Center for Missing and Exploited Children, law-enforcement authorities, or other competent child-safety bodies as required or permitted by law.
Creators and users may not involve minors in private creator sessions or portray minors in exploitative, sexualized, dangerous, or privacy-invasive contexts. Any otherwise lawful content depicting a minor must be appropriate, necessary, and shared only with all required rights and guardian permissions.
If we reasonably suspect that a user is underage, we may request age assurance, restrict the account during review, and terminate it if adult eligibility is not established.
23.Prohibited Uses and Platform Integrity
In addition to other restrictions in these Terms, you must not misuse the Services or help another person do so.
- Do not access accounts, data, systems, or non-public areas without authorization, and do not bypass security, age, verification, payment, moderation, or access controls.
- Do not introduce malware, overload infrastructure, disrupt sessions, probe vulnerabilities, interfere with other users, or use Tela to send spam, phishing, or deceptive communications.
- Do not scrape, harvest, index, or collect user information or UGC through automated means except through an authorized interface and within its written conditions.
- Do not use bots, scripts, account farms, false identities, collusion, self-gifting, or payment manipulation to inflate engagement, rankings, Lights, gifts, bookings, or earnings.
- Do not impersonate Tela, a creator, another user, a professional, or a public authority, and do not misrepresent affiliation, endorsement, credentials, location, or transaction purpose.
- Do not use Tela to facilitate unauthorized commercial solicitation, sexual services, gambling, money laundering, trafficking, illegal goods, or any transaction designed to evade marketplace fees or safety controls.
- Do not reverse engineer, copy, resell, sublicense, or commercially exploit the Services or Tela-provided content except as expressly authorized or permitted by non-waivable law.
We may investigate suspected misuse, preserve relevant evidence, reverse improperly obtained benefits, and cooperate with marketplaces, payment providers, rights holders, and authorities as permitted by law.
24.Privacy, Permissions, and Communications
The Tela Privacy Policy explains how personal information is collected, used, stored, shared, and protected, and how users may exercise privacy rights. By using the Services, you acknowledge that the Privacy Policy applies to Tela's processing of personal information.
Some features require device permissions, such as camera, microphone, photo-library, location, or notification access. You control permissions through the operating system. Disabling a permission may prevent the related feature from working but should not prevent unrelated core functions.
You agree that we may send service communications electronically, including account, security, verification, purchase, booking, payout, safety, and policy notices. These operational communications may be necessary to provide the Services. Where permitted, we may also send optional product news, and you may unsubscribe using the offered controls.
You are responsible for keeping your email address and other contact information current. Electronic notices are effective when sent to the address associated with your account, delivered in the app, or posted prominently through the Services, subject to applicable law.
25.Third-Party Services and App Marketplaces
The Services may rely on or link to third-party services, including app marketplaces, payment and payout providers, identity-verification providers, communications infrastructure, sign-in services, analytics, content-delivery networks, and external websites.
Third parties may apply their own terms and privacy notices to activities they independently control. Tela does not control external content, availability, security, billing decisions, or practices and is not responsible for a third party's acts or omissions except where applicable law provides otherwise.
Your relationship with an app marketplace is governed by its terms. Marketplace availability, family-sharing rules, payment methods, refunds, subscription management, and device eligibility may differ by storefront or region.
Open-source software and third-party components included in Tela may be subject to separate license terms. Those licenses govern to the extent they conflict with the limited license in Section 5.
26.Service Availability, Changes, and Beta Features
Tela may add, modify, test, limit, suspend, or discontinue features to improve the Services, comply with law, respond to safety risks, address technical needs, or adapt the creator program. Features may vary by platform, device, account type, creator, language, region, or age rating.
We will provide reasonable notice of material changes when required by law or when practicable. We do not guarantee uninterrupted, error-free, or permanent availability. Maintenance, network conditions, provider outages, legal restrictions, and events beyond reasonable control may affect access.
Beta, preview, experimental, or test features may be incomplete, changed, or withdrawn without notice and are provided for evaluation. You should not rely on them for critical activity. Feedback you voluntarily provide may be used without restriction or payment, but Tela will not publicly identify you as the source without permission.
You are responsible for keeping your app version and device software reasonably current and for maintaining copies of UGC you need. Tela is not a general backup or archival service.
27.Suspension, Termination, and Account Deletion
You may stop using Tela at any time and may request account deletion through the available in-app path or by contacting service@tela.love if you cannot access the account. You should resolve pending creator sessions, purchases, disputes, and payouts before deletion when possible.
Tela may warn, restrict, suspend, or terminate an account or feature if we reasonably believe that you violated these Terms, created a safety or legal risk, engaged in fraud or payment abuse, infringed rights, failed verification, remained inactive for an extended period after notice, or used a feature that is being lawfully discontinued.
For serious risks, including apparent CSAE, credible threats, fraud, account compromise, or evidence destruction, action may be taken immediately and without prior notice. Where appropriate and legally permitted, we will explain the general reason and provide an appeal route.
Upon termination, your license to use the Services ends. UGC may be removed from active display, subject to backups, prior sharing, safety evidence, legal holds, and other retention described in the Privacy Policy. Purchased items, refunds, creator earnings, and outstanding obligations will be handled under Sections 18 through 21 and applicable law.
Provisions that by their nature should survive termination remain effective, including ownership, licenses needed for retained copies, payment obligations, intellectual property, disclaimers, liability limits, indemnification, dispute terms, and miscellaneous provisions.
28.Additional Terms for Apple Users
If you obtain Tela through Apple's App Store, you acknowledge that these Terms are between you and Tela, not Apple. Tela, not Apple, is solely responsible for the application and its content, subject to these Terms and applicable law.
Your license is limited to using Tela on Apple-branded products that you own or control and as permitted by the Apple Media Services Terms and applicable Usage Rules, including any permitted Family Sharing or volume-purchase access.
Apple has no obligation to provide maintenance or support for Tela. If Tela fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the application, if any, as required by its rules. To the maximum extent permitted by law, Apple has no other warranty obligation regarding Tela.
Tela, not Apple, is responsible for addressing claims relating to the application, including product-liability claims, legal or regulatory compliance claims, consumer-protection claims, and claims that the application infringes a third party's intellectual property rights.
You represent that you are not located in a country or region subject to a United States government embargo or designated as supporting terrorism, and that you are not listed on a United States government prohibited or restricted-party list, except where such representation is not legally required or applicable.
Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the Apple-specific provisions against you upon your acceptance of the Terms. Questions and support requests for Tela should be directed to service@tela.love.
29.Disclaimers, Limitation of Liability, and Indemnification
Service Disclaimers
To the maximum extent permitted by law, the Services are provided on an AS IS and AS AVAILABLE basis. Tela disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, and any warranty arising from course of dealing or usage of trade.
Tela does not warrant that the Services will always be available, secure, accurate, error-free, or free from harmful components, or that content, creators, recommendations, verification, sessions, or monetization will meet your expectations. Verification and moderation reduce risk but do not guarantee identity, qualifications, lawful conduct, or content quality.
UGC and creator statements are provided by users. Tela does not endorse or assume responsibility for opinions, advice, offers, products, services, or off-platform arrangements. You are responsible for evaluating content and using appropriate caution.
Limitation of Liability
To the maximum extent permitted by law, Tela and its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, opportunity, or business interruption, arising from or related to the Services, even if advised that such damage was possible.
To the maximum extent permitted by law, the total aggregate liability of Tela and the related parties for all claims arising from or related to the Services or these Terms will not exceed the greater of the amount you paid to Tela through the Services during the 12 months before the event giving rise to the claim or USD 100.
These exclusions and limits do not apply to liability that cannot lawfully be excluded or limited, which may include liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, willful misconduct, gross negligence, or violation of non-waivable consumer rights. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.
Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless Tela and its affiliates, officers, employees, and agents from third-party claims, damages, losses, liabilities, costs, and reasonable legal fees arising from your UGC, your creator activity, your breach of these Terms, your violation of law or another person's rights, or your misuse of the Services.
For consumers, this obligation applies only to the extent a claim results from your wrongful act or omission and only where such an obligation is enforceable. Tela will provide reasonable notice of an indemnified claim and may control the defense, while allowing reasonable participation at your expense. You may not settle a claim in a way that imposes liability or admissions on Tela without written consent.
30.Governing Law, Disputes, Changes, and Contact
Governing Law and Consumer Rights
Unless mandatory local law provides otherwise, these Terms and disputes arising from them are governed by the laws of the jurisdiction in which the operator identified for Tela in the applicable app store is established, without regard to conflict-of-law rules.
If you are a consumer, you retain any mandatory protections provided by the law of your country or region of residence. Nothing in these Terms requires you to waive a right that cannot legally be waived.
Informal Resolution and Courts
Before filing a formal claim, you and Tela agree to make a good-faith effort to resolve the dispute informally. Send a written notice to service@tela.love describing the issue, relevant account, requested resolution, and supporting transaction information. The parties will allow 30 days for a response and discussion unless urgent relief is reasonably necessary.
If the dispute is not resolved, either party may bring it before a court with lawful jurisdiction. Unless mandatory consumer law permits a different forum, the competent courts where the Tela operator is established will have jurisdiction. Either party may seek urgent injunctive or protective relief to prevent unauthorized access, intellectual property infringement, exploitation, or immediate harm.
Changes to These Terms
Tela may update these Terms to reflect new features, business practices, safety measures, legal requirements, or clearer explanations. The Effective Date at the beginning identifies the current version.
If a change materially affects your rights or obligations, we will provide notice appropriate to the change, such as an in-app notice, email, or prominent website notice. Where required by law, we will request renewed agreement. Continued use after the effective date of an update constitutes acceptance only to the extent permitted by law.
Miscellaneous
These Terms and incorporated policies are the entire agreement concerning the Services and replace prior agreements on the same subject. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions will remain effective.
You may not assign these Terms or transfer rights under them without Tela's written consent. Tela may assign these Terms in connection with a merger, acquisition, restructuring, financing, sale of assets, or transfer of the Services, subject to applicable law and continued protection of non-waivable consumer rights.
Section headings are for convenience and do not limit meaning. The words including and such as mean including without limitation. Notices may be provided electronically as described in Section 24.
